Mark acts for many of the leading professional indemnity insurers and their insured clients.
Mark’s practice is focused upon defending professional negligence claims, with a particular emphasis on claims against accountants and tax professionals.
Mark’s recent experience includes:

  • Acting in the defence of multiple claims arising from tax mitigation schemes in the form of EBTs, film and property investment schemes;
  • Appearing in the First Tier Tax Tribunal to challenge HMRC’s interpretation of the rules regarding Enterprise Management Incentives;
  • Defending a £1m claim against a tax professional arising out of the alleged failure to claim several years' worth of R&D tax relief

Sarah Crowther
Partner
Sarah specialises in Professional Indemnity, Directors & Officers and Financial Institutions coverage disputes and defence work. She has over 15 years’ experience advising clients across a range of sectors.
Sarah contributes to articles for both the Insurance and National press, and to our Informed Insurance thought leadership and predictions, and is DACB’s representative for ClimateWise, part of the Centre for Sustainable Finance.
Sarah’s cases generally involve complex, high value claims, often with an international element. She is experienced in mediation and arbitration. Sarah has a strong understanding of the London Market having undertaken secondments in the claims teams at two Insurers and in the legal team at a global insurance brokerage.

Lindsay Elliott
Senior Associate
Lindsay specialises in financial services dispute resolution and has almost 20 years’ experience in dealing with claims against accountants, auditors, financial advisers, wealth management firms and other financial institutions. She is regularly instructed on behalf of financial services professionals and insurers to defend and resolve litigated claims, FOS complaints and regulatory matters. She also advises insurers on policy coverage issues and coverage challenges. Lindsay has extensive experience in tax scheme litigation and across the spectrum of investments, including film finance partnership schemes, carbon-trading, EBTs, the Keydata litigation, traded life policies, ARM, Arch Cru, GTEPS, UCIS and VCTs among others.

Lindsay’s recent experience includes:

  • Winning a Trial judgment dismissing court proceedings against a large UK firm in relation to film finance schemes (including winning a costs order of £800,000), and successfully defending litigation bought by other co-investors in the same schemes.
  • Acting for a defendant firm (and its insurers) in the high profile Ingenious and Scion tax scheme litigation involving claims exceeding £100million brought by more than 500 claimants against more than 100 defendants.
  • Defending an accountancy firm against multiple claims resulting from various tax schemes and alleged undisclosed introducer fees, alongside handling the accompanying ICAEW disciplinary proceedings.
  • Acting in the defence of claims against accountants and auditors arising out of allegedly negligent audit services.
  • Assisting an accountancy firm in responding to issues arising from changes in audit authorisations relating to the Brexit transition period, including advising on their regulatory self-reporting obligations.
