CIOT comments, sent to HMRC 20 December 2013, in response to the OTS report on definitions in taxation.
The report was part of a project that the OTS is carrying out to identify and emasure the factors responsible for tax complexity. As part of the project, definitions in tax legislation have been considered and this paper was the first stage of this project. It outlined initial findings, identified commons themes and considered some suggestions and guidelines for a ‘good’ definition.
It has looked at three Acts in some detail:
- Corporation Tax Act 2010
- Inheritance Tax Act 1984
- Taxation of Capital Gains Act 1992
Throughout the paper there are a number of questions and the OTS asked for feedback or comment on these, on the paper as a whole or on their complexity project generally.
