Article by Richard Sowler, partner, Watson Burton LLP. This article appeared in the October 2006 issue of Tax Adviser. This article does not attempt to describe the new rules brought about by FA 2006 in detail, but focuses on what action may be available to trustees in various circumstances to mitigate the impact of certain of them. In particular, it says little about the 'new kids on the block': 'trusts for bereaved minors', '18 to 25 trusts', 'immediate post-death interests' and 'self-settlements by person with condition expected to lead to disability', save to remark here that most of them can have attractions only in very limited circumstances.
