Keith M Gordon considers Small v Mars UK Ltd.

In the spring of 2004, the Special Commissioners published their decision in the joined appeals by two well-known companies, Mars UK Ltd and William Grant & Sons Distillers Ltd. In both cases, the taxpayers won and the Inland Revenue has appealed against the decision. Because Mars is an English company, the appeal was heard by the High Court; the William Grant appeal is currently being heard by the Court of Session in Scotland. It is possible that the two cases will come together again in the House of Lords next year.
