Jerome v Kelly: give and let die
|Category|| Technical Articles
Until Finance Act 1991 it was possible for assets to be transferred to an offshore trust without immeditely generating a chargeable disposal for CGT purposes. The case of Jerome v Kelly concerned an arrangement in that context. This article by Keith Gordon, barrister, chartered accountant and tax adviser, appeared in the August 2004 issue of Tax Adviser.
Due to an editorial error, the reference to FA 1992 should read 'TCGA 1992'.
